Ist\u00e4llet har ansvarets inneb\u00f6rd utvecklats genom en kombination av flera regelverk och r\u00e4ttsk\u00e4llor.<\/span><\/p><p><span style=\"font-weight: 400;\">Rehabiliteringsarbetet syftar i praktiken till att st\u00f6dja en arbetstagare med nedsatt arbetsf\u00f6rm\u00e5ga att m\u00f6jligen kunna \u00e5terv\u00e4nda till eller bibeh\u00e5lla syssels\u00e4ttning, ofta i samverkan mellan arbetsgivare, F\u00f6rs\u00e4kringskassan samt h\u00e4lso- och sjukv\u00e5rden.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-15b4d451 e-flex e-con-boxed e-con e-parent\" data-id=\"15b4d451\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t<div class=\"elementor-element elementor-element-546a129f e-con-full e-flex e-con e-child\" data-id=\"546a129f\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-458ec35e elementor-widget elementor-widget-heading\" data-id=\"458ec35e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Grund i arbetsmilj\u00f6lagen<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-442c6b68 elementor-widget elementor-widget-text-editor\" data-id=\"442c6b68\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Rehabiliteringsansvaret tar i stor utstr\u00e4ckning sin utg\u00e5ngspunkt <\/span><span style=\"font-weight: 400;\">i <a href=\"https:\/\/rbjurist.se\/arbetsratt\/arbetsmiljo\/\">Arbetsmilj\u00f6lagen<\/a><\/span><span style=\"font-weight: 400;\"> (1977:1160), som st\u00e4ller krav p\u00e5 att arbetsgivaren ska f\u00f6rebygga oh\u00e4lsa och vidta \u00e5tg\u00e4rder f\u00f6r att skapa en god arbetsmilj\u00f6. Arbetstagaren har ett eget ansvar att aktivt medverka i processen.<\/span><\/p><p><span style=\"font-weight: 400;\">Det inneb\u00e4r bland annat att l\u00e4mna relevant information om sin arbetsf\u00f6rm\u00e5ga, delta i planering och uppf\u00f6ljning samt bidra till att f\u00f6reslagna \u00e5tg\u00e4rder kan genomf\u00f6ras i m\u00f6jligaste m\u00e5n.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Arbetstagarens bristande medverkan i rehabiliterings\u00e5tg\u00e4rder kan i vissa fall f\u00e5 betydelse f\u00f6r hur arbetsgivarens rehabiliteringsansvar bed\u00f6ms. Om den anst\u00e4llde inte deltar i planerade insatser kan det leda till att arbetsgivaren anses ha uppfyllt sitt ansvar.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Detta kan i sin tur inneb\u00e4ra att det f\u00f6rst\u00e4rkta skydd som normalt g\u00e4ller vid sjukdom f\u00f6rsvagas eller upph\u00f6r, eftersom en f\u00f6ruts\u00e4ttning f\u00f6r detta skydd \u00e4r att arbetstagaren aktivt medverkar i sin rehabilitering.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-1236f5b e-flex e-con-boxed e-con e-parent\" data-id=\"1236f5b\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t<div class=\"elementor-element elementor-element-1a5fc017 e-con-full e-flex e-con e-child\" data-id=\"1a5fc017\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-59ca9e39 elementor-widget elementor-widget-heading\" data-id=\"59ca9e39\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Rehabiliteringens roll vid upps\u00e4gning<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-130df358 elementor-widget elementor-widget-text-editor\" data-id=\"130df358\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Ansvarets omfattning p\u00e5verkas \u00e4ven av reglerna om sakliga sk\u00e4l f\u00f6r upps\u00e4gning i lagen om anst\u00e4llningsskydd (1982:80).
